Belgium: Council for Alien Law Litigation rules on scope of application of the Dublin III Regulation and the Returns Directive

The Belgian Council for Alien Law Litigation has provided guidance on the scope of application of the Dublin III Regulation and the Returns Directive, in view of four of its recent decisions (no 200 933no 200 976 and no 200 977). It noted that when the Aliens Office wishes to transfer a third country national irregularly staying in Belgium to a Member State responsible for his or her asylum application, the provisions and guarantees under the Dublin III Regulation (DRIII) apply, regardless of whether the applicant has lodged an asylum application in Belgium. Therefore, with the application of the DRIII, a decision that is taken without respect to the procedures and guarantees under that Regulation will be unlawful.

Moreover, the Council for Alien Law Litigation draws a sharp distinction between the scope of application of the DRIII and the Returns Directive, which is not left to the discretion of the Aliens Office.
