The notarial practice of European private international law has been confronted since 2014 with the application of new international instruments and reforms. The author uses the exhibition method of the previous editions, accompanying her comments with 283 examples.
An important part of the book remains dedicated to the private international family law.
The marriage chapter includes a strong presentation on same-sex marriage, while the introduction of divorce without a judge since 1 January 2017 justifies new developments on the issues raised by this institution in private and European international law. The three legal systems applicable over time to the matrimonial regime of international couples, including the regulation on matrimonial property regimes applicable from 29 January 2019 are being described in detail. Following the coming into force of the probate settlement of July 4, 2012, the study of international successions distinguishes between the common law regime applicable to estate acquired before August 17, 2015 and the European probate regime applicable to estate acquired from of this date and on.
The notarial aspects of private international contract law are updated. The condition of foreigners in France has undergone many reforms in the area of residence permits and the exercise of foreign trade. Marital status takes into account the issues raised by surrogacy. Financial relations with foreign countries emphasize the role of the notary in money laundering.
Lastly, detailed comparative law information on matrimonial property regimes, estate, the age of majority or the taxation of estates for a considerable number of states contributes to the enrichment of the book. The analysis of the evolution of foreign domestic legislation and the updating of the French and international jurisprudence of the ECHR and the ECJ constitute valuable documentation.
The book is intended primarily for notaries and their collaborators and also allows students and practitioners to access the practice of private international law and European family and contracts.
